TERMS OF SERVICE

1. ACCEPTANCE OF TERMS

By downloading, installing, or using the "Are You Fluent?" application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Parallax Interactive, LLC ("Company," "we," "us," or "our").

2. DESCRIPTION OF SERVICE

Are You Fluent? is a language learning application that provides daily interactive quizzes based on real news stories. Content is refreshed periodically and may vary by language pair and difficulty tier.

3. USER ACCOUNTS

You may be required to create an account to access certain features of the App. You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. USER CONDUCT

You agree not to:

• Use the App for any unlawful purpose or in violation of any applicable laws
• Attempt to reverse engineer, decompile, or disassemble the App
• Interfere with or disrupt the App's servers or networks
• Use automated means to access or collect data from the App
• Impersonate any person or entity, or misrepresent your affiliation
• Share, redistribute, or commercially exploit the App's content without permission

5. INTELLECTUAL PROPERTY

All content in the App, including but not limited to text, graphics, images, artwork, quizzes, logos, and software, is the property of Parallax Interactive, LLC or its licensors and is protected by copyright, trademark, and other intellectual property laws. News content used to generate quizzes is sourced from publicly available RSS feeds and is used for educational purposes.

6. CONTENT ACCURACY

While we strive for accuracy, content may occasionally contain errors. The App is intended as a supplementary language learning tool and should not be relied upon as the sole source of language education.

7. DISCLAIMERS

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or free of harmful components.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PARALLAX INTERACTIVE, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF THE APP.

9. MODIFICATIONS TO TERMS

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to the App or our website. Your continued use of the App after any changes constitutes your acceptance of the new Terms.

10. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
